Indian Constitution Amendments Acts and it's Importance

The indian constitution amendments acts of 1951 and 1973 are important because they transformed india into an independent country.

Free Bihar from the requirement to have a tribal welfare minister and extend the same to Jharkhand and Chhattisgarh. This provision now applies to the two newly formed states that are already in force as well as Madhya Pradesh and Odisha (Article 164(1)).

After India and Pakistan signed the Nehru Noon Agreement to carve up the Berubari Union territory, the West Bengal government refused. The Union has since referred the matter to the SC, which has ruled that the power of Parliament to reduce the territory of a state (under Section 3) does not extend to the cession of Indian territory to a foreign country. Therefore, Indian territories can only be ceded to foreign countries through amendments to Article 368 of the Constitution. Therefore, the 9th Constitutional Amendment (1960) was enacted.

The federal territories have no say in constitutional amendments, including the ratification process, which is open only to the states. Delhi, Pondicherry and Jammu and Kashmir are three Union Territories that, through special constitutional amendments, have the right to have an elected Legislative Assembly and a Cabinet of Ministers, thus enjoying some government powers. These three regions can participate in the approval process.

Constitutional amendments were made to facilitate changes in the territorial scope of the Republic of India due to the merger of the former French colony Pondicherry, the former Portuguese colony Goa and a small territorial exchange with Pakistan. Changes are also required in the coastal entitlement of the 200-mile exclusive economic zone and the formation of new national and federal territories through the reorganization of existing states. The constitutional amendment under Article 368 allows the peaceful division of nations, provided that all resulting nations guarantee fundamental rights (Article 13). The Constitution (Ninth Amendment) Act of 1960 is an example of how territory was ceded to old Pakistan.

The constitutional revision process reflects the desire of the Constituent Legislative Assembly to create a dynamic document. The Constitution of India provides for three different amendment procedures, combining flexibility and rigidity.

Amendment of the Indian constitution is the process of changing the basic law or the supreme law of the country. Section XX (Article 368) of the Constitution of India sets out the procedure for amending the Constitution. This procedure ensures the sanctity of the Indian constitution and controls the arbitrary powers of the Indian Parliament.
